These Terms of Service ("Terms") govern your use of the Summit mobile application ("the App," "Summit") developed by Summit Systems, LLC ("Developer," "we," "our," or "us"). By downloading, installing, or using Summit, you agree to be bound by these Terms. If you do not agree, do not use Summit.
Summit is an AI-powered fitness coaching application for iOS. Summit allows you to log workouts, set fitness goals, track recovery metrics, and receive personalized coaching content generated by artificial intelligence.
Summit's AI coaching is powered by Anthropic's Claude API. When you use Summit's coaching features, your workout data, health metrics, and profile information are sent to Anthropic's servers to generate coaching responses. This is the core function of the App.
Summit's coaching content — including training plans, workout recommendations, recovery guidance, debriefs, briefings, and conversational responses — is generated by Anthropic's Claude AI model algorithmically based on your data and the model's training.
AI-generated coaching content may not always be accurate, appropriate, or optimal for your individual circumstances. AI models can produce responses that are:
Exercise your own judgment when following any AI-generated recommendation. If a recommendation does not feel right, causes pain, or conflicts with your physician or qualified trainer — do not follow it.
Summit does not guarantee any specific fitness outcomes, performance improvements, or health results. Individual results vary based on genetics, adherence, nutrition, sleep, stress, and many other variables outside the App's control.
You must be at least 18 years old to use Summit. By using Summit, you represent and warrant that you are 18 years of age or older. If you are under 18, do not download or use Summit.
Summit may require a Claude API key from Anthropic to function. If you provide your own API key, you are responsible for:
Summit stores your API key in the iOS Keychain and uses it solely to authenticate requests to Anthropic on your behalf. Summit is not responsible for charges incurred through your Anthropic account.
Summit offers an auto-renewing monthly subscription that includes a quota of AI coach interactions per billing month. Bringing your own Anthropic Claude API key (Section 4.2) is an alternative; you do not need a subscription if you supply your own key.
Free Trial. New subscribers may be eligible for a free introductory trial period (two weeks at launch; the current trial length is shown in-App on the subscription screen at the time you subscribe). The trial begins when you start the subscription. If you do not cancel before the trial ends, the subscription converts automatically to a paid subscription at the price shown on the subscription screen, and you will be charged through your Apple ID.
Auto-Renewal. Subscriptions auto-renew at the end of each billing period at the then-current rate unless you cancel at least 24 hours before the end of the current period. The renewal charge is processed by Apple within 24 hours before the end of the current period.
Managing or Cancelling. You can view, manage, or cancel your subscription at any time in iOS Settings → [Your Name] → Subscriptions → Summit. Cancelling stops future auto-renewal; you keep access to subscriber features until the end of the current paid period. Summit cannot cancel or refund a subscription on your behalf — these actions are handled by Apple.
Price Changes. If we change the subscription price, Apple will notify you in advance through the standard App Store mechanism. You may accept the new price or cancel before the change takes effect.
Refunds. All billing is handled by Apple under the standard Apple Media Services terms. Refunds, if any, are issued by Apple at Apple's discretion under those terms — Summit does not directly issue refunds. Refund requests are made through reportaproblem.apple.com.
Coach Message Quota. Each monthly billing period includes a quota of AI coach interactions, as displayed in the App. If you exhaust the quota before the period ends, AI coach interactions will be paused for the remainder of that period unless you supply your own Anthropic API key. The quota resets at the start of each new billing period.
Subscriptions Are Required for Some Features Only. Subscription gives you access to AI coaching features. Other App features (workout logging, recovery logging, history viewing) do not require a subscription.
Summit, including its design, code, user interface, and branding, is the intellectual property of Summit Systems, LLC and is protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the App.
Coaching content generated by Summit's AI is produced by Anthropic's Claude model in response to your data. You may use this content for your personal fitness purposes. The intellectual property status of AI-generated content is an evolving area of law, and we make no representations about ownership of AI-generated coaching text.
You retain ownership of all data you provide to Summit, including your profile information, workout logs, recovery notes, and any other content you create within the App.
Summit's collection, use, and sharing of your data is governed by our Privacy Policy. By using Summit, you agree to the data practices described in the Privacy Policy.
Summit depends on Anthropic's Claude API to provide coaching functionality. Anthropic is an independent third party. Your use of Summit's coaching features is also subject to Anthropic's terms of service and privacy policy at anthropic.com.
We do not control Anthropic's services. If Anthropic's API is unavailable, changes its terms, or discontinues service, Summit's coaching features may be degraded or unavailable. We are not responsible for the availability, performance, or conduct of Anthropic's services.
Summit's integration with Apple HealthKit, Apple iCloud (for cross-device sync), and the App Store (for subscription billing) is subject to Apple's terms and conditions. We are not responsible for the accuracy or availability of data provided by Apple's services. Refunds and billing are handled exclusively by Apple under Apple Media Services terms (see Section 4.3).
Summit uses Sentry's crash-reporting service to receive diagnostic reports when the App crashes or encounters non-fatal errors. Sentry receives anonymized stack traces, device model, OS version, app version, breadcrumb trails, and non-identifying app-state tags. Sentry does not receive your name, IP address, HealthKit data, workout content, or coaching conversations. Crash reporting is integral to App quality and is not user-configurable. Your use of Summit is subject to Sentry's privacy policy at sentry.io/privacy.
SUMMIT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that Summit will meet your requirements; will be uninterrupted, timely, or error-free; that AI-generated content will be accurate or appropriate; that fitness results will be achieved; or that defects will be corrected.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SUMMIT SYSTEMS, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SUMMIT SYSTEMS, LLC'S TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP, OR FIFTY U.S. DOLLARS ($50.00), WHICHEVER IS GREATER.
You acknowledge that physical exercise involves inherent risks, including risk of injury, illness, disability, and death. You voluntarily assume all risks associated with your use of Summit and any exercise undertaken based on Summit's content.
You agree to indemnify, defend, and hold harmless Summit Systems, LLC from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
You may stop using Summit at any time by deleting the App from your device. Deleting the App removes all locally stored data.
We reserve the right to discontinue Summit or any of its features at any time, with or without notice. We are not obligated to maintain, update, or support the App indefinitely.
Upon termination, your right to use Summit ceases. Sections 2 (Not Medical Advice), 9 (Disclaimers and Limitation of Liability), 10 (Indemnification), and 13 (Governing Law) survive termination.
We may modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this document. Your continued use of Summit after changes are posted constitutes your acceptance of the revised Terms. If you do not agree with the revised Terms, you must stop using Summit.
These Terms are governed by and construed in accordance with the laws of Arizona, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or your use of Summit shall be resolved in the courts of Arizona, and you consent to the personal jurisdiction of such courts.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Summit Systems, LLC regarding your use of Summit and supersede any prior agreements or understandings.
By using Summit, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
