These Terms of Service ("Terms") govern your use of the Summit mobile application ("the App," "Summit") developed by Summit Systems, LLC ("Developer," "we," "our," or "us"). By downloading, installing, or using Summit, you agree to be bound by these Terms. If you do not agree, do not use Summit.
Summit is a fitness coaching application for iOS. Summit allows you to log workouts, set fitness goals, track recovery metrics, and optionally receive personalized coaching powered by artificial intelligence. Summit is structured around two coaching modes:
Summit's coaching content — including training plans, workout recommendations, recovery guidance, debriefs, briefings, and conversational responses — is generated by Anthropic's Claude AI model algorithmically based on your data and the model's training.
AI-generated coaching content may not always be accurate, appropriate, or optimal for your individual circumstances. AI models can produce responses that are:
Exercise your own judgment when following any AI-generated recommendation. If a recommendation does not feel right, causes pain, or conflicts with your physician or qualified trainer — do not follow it.
Summit does not guarantee any specific fitness outcomes, performance improvements, or health results. Individual results vary based on genetics, adherence, nutrition, sleep, stress, and many other variables outside the App's control.
You must be at least 18 years old to use Summit. By using Summit, you represent and warrant that you are 18 years of age or older. If you are under 18, do not download or use Summit.
AI coaching features (conversational coaching, daily briefings, post-workout debriefs, and AI-generated training plans) are gated behind a one-time in-app purchase. There is no subscription, no auto-renewal, and no free trial for AI coaching.
One-Time Unlock. To use AI coaching, you must purchase the Summit AI Coaching unlock — a one-time, non-consumable in-app purchase processed through Apple. The unlock is permanent; you will not be charged again for the same Apple ID. The current price is shown in-App at the time of purchase. Upon successful purchase, a starter allotment of coaching credits is added to your account.
Coaching Credits. AI coaching interactions consume coaching credits from your balance. The amount consumed per interaction varies based on the length and complexity of each exchange; the App displays your approximate remaining balance as an estimated number of messages. Credits are non-expiring and carry over indefinitely.
Credit Top-Ups. When your credit balance is low, you may purchase additional coaching credit packs — consumable in-app purchases processed through Apple. Each pack adds a fixed credit amount to your balance at the price shown in-App. There is no auto-renewal; you purchase only when you choose to.
Sign In with Apple. Sign In with Apple is required during onboarding to create your Summit account. Your account is needed for iCloud backup, purchase restore, and (when applicable) your AI coaching credit balance. You may tap "Skip for now" during setup to defer account creation, but purchase restore and credit balance will not be available without an account.
No Subscription Required. Summit does not offer an auto-renewing subscription. All purchases are one-time or consumable in-app purchases with no recurring charges.
Refunds. All billing is processed by Apple under the Apple Media Services terms. Refunds, if any, are issued by Apple at Apple's discretion. Summit does not directly issue refunds. Refund requests are submitted through reportaproblem.apple.com. If Apple grants a refund for a credit pack, the associated credits may be removed from your account.
Free Features. Workout logging, recovery logging, history viewing, and on-device training plans are free and do not require any purchase.
Summit, including its design, code, user interface, and branding, is the intellectual property of Summit Systems, LLC and is protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the App.
Coaching content generated by Summit's AI is produced by Anthropic's Claude model in response to your data. You may use this content for your personal fitness purposes. The intellectual property status of AI-generated content is an evolving area of law, and we make no representations about ownership of AI-generated coaching text.
You retain ownership of all data you provide to Summit, including your profile information, workout logs, recovery notes, and any other content you create within the App.
Summit's collection, use, and sharing of your data is governed by our Privacy Policy. By using Summit, you agree to the data practices described in the Privacy Policy. Data handling differs by coaching mode:
Summit depends on Anthropic's Claude API to provide coaching functionality. Anthropic is an independent third party. Your use of Summit's coaching features is also subject to Anthropic's terms of service and privacy policy at anthropic.com.
We do not control Anthropic's services. If Anthropic's API is unavailable, changes its terms, or discontinues service, Summit's coaching features may be degraded or unavailable. We are not responsible for the availability, performance, or conduct of Anthropic's services.
Summit's integration with Apple HealthKit, Apple iCloud (for cross-device sync), Sign in with Apple (for account creation), and the App Store (for in-app purchases) is subject to Apple's terms and conditions. We are not responsible for the accuracy or availability of data provided by Apple's services. Refunds and billing are handled exclusively by Apple under Apple Media Services terms (see Section 4.2).
Summit uses Sentry's crash-reporting service to receive diagnostic reports when the App crashes or encounters non-fatal errors. Sentry receives anonymized stack traces, device model, OS version, app version, breadcrumb trails, and non-identifying app-state tags. Sentry does not receive your name, IP address, HealthKit data, workout content, or coaching conversations. Crash reporting is integral to App quality and is not user-configurable. Your use of Summit is subject to Sentry's privacy policy at sentry.io/privacy.
SUMMIT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that Summit will meet your requirements; will be uninterrupted, timely, or error-free; that AI-generated content will be accurate or appropriate; that fitness results will be achieved; or that defects will be corrected.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SUMMIT SYSTEMS, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SUMMIT SYSTEMS, LLC'S TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP, OR FIFTY U.S. DOLLARS ($50.00), WHICHEVER IS GREATER.
You acknowledge that physical exercise involves inherent risks, including risk of injury, illness, disability, and death. You voluntarily assume all risks associated with your use of Summit and any exercise undertaken based on Summit's content.
You agree to indemnify, defend, and hold harmless Summit Systems, LLC from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
You may stop using Summit at any time by deleting the App from your device. Deleting the App removes all locally stored data (workout logs, recovery history, settings). Your AI coaching credit balance is stored on Summit's servers and is not deleted when you delete the App — if you reinstall, your one-time unlock and remaining credits are restored via your Apple ID.
We reserve the right to discontinue Summit or any of its features at any time. We are not obligated to maintain, update, or support the App indefinitely. If we discontinue AI coaching features, we will provide reasonable advance notice where feasible.
Upon termination, your right to use Summit ceases. Unused coaching credits have no cash value and are not redeemable upon termination, except as may be required by Apple's refund policies or applicable law. Sections 2 (Not Medical Advice), 9 (Disclaimers and Limitation of Liability), 10 (Indemnification), and 13 (Governing Law) survive termination.
We may modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this document. Your continued use of Summit after changes are posted constitutes your acceptance of the revised Terms. If you do not agree with the revised Terms, you must stop using Summit.
These Terms are governed by and construed in accordance with the laws of Arizona, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or your use of Summit shall be resolved in the courts of Arizona, and you consent to the personal jurisdiction of such courts.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Summit Systems, LLC regarding your use of Summit and supersede any prior agreements or understandings.
By using Summit, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
